8 · Acknowledgment of risk & assumption of responsibility
By purchasing, receiving, opening, handling, or otherwise using this product, the buyer, recipient, and every end user (together, the “Researcher”) acknowledges that they have read, understood, and accepted this Safety Data Sheet in full, and expressly agrees to each of the following:
- Research use only. The Researcher confirms that this product is a research chemical supplied solely for in-vitro and/or in-vivo laboratory research by qualified professionals. It is not a drug, medicine, dietary supplement, cosmetic, food, or medical device; it is not sterile or pyrogen-free; and it is not for human or veterinary use, consumption, ingestion, inhalation, injection, or administration of any kind.
- Qualification and competence. The Researcher represents and warrants that they are of legal age, are a qualified researcher or research institution, and are competent to receive and handle research chemicals safely, and that the product will be handled only by trained personnel using appropriate protective equipment and laboratory controls.
- Assumption of all risk. The Researcher voluntarily and knowingly assumes all risks of every kind arising from or connected with the product — including its purchase, receipt, transport, storage, handling, use, misuse, and disposal — whether those risks are known or unknown, foreseen or unforeseen. The product is supplied strictly “as is” and “with all faults,” with no warranty of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, safety, or non-infringement.
- Sole responsibility and legal compliance. The Researcher accepts sole and complete responsibility for the safe and lawful receipt, handling, use, and disposal of the product, and for determining and complying with all laws, regulations, licences, and institutional requirements that apply in their jurisdiction — including those governing import, export, possession, handling, use, and disposal. XV Molecular makes no representation that the product is lawful in the Researcher’s jurisdiction.
- Release and indemnification. To the fullest extent permitted by law, the Researcher releases and forever discharges XV Molecular and its owners, officers, employees, suppliers, and agents from any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to the product, and agrees to indemnify and hold them harmless against any such claim brought by the Researcher or by any third party.
- Limitation of liability. XV Molecular shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages of any kind arising from or related to the product, even if advised of the possibility of such damages. Nothing in this acknowledgment excludes or limits any liability that cannot be excluded or limited under applicable law.
- Acceptance or return. If the Researcher does not accept these terms in full, they must not open or use the product and must return it unused and intact. Opening, handling, or using the product constitutes full and irrevocable acceptance of this acknowledgment.
